    By submitting this Offer Submission Form, I acknowledge that I have received and reviewed the Property Information Package, including all available disclosures, reports, and supporting documents, either in person or online. I understand that it is my responsibility to conduct my own due diligence regarding all aspects of the property prior to submitting an offer.
  2. Non-Binding Offer Submission
    I understand and agree that this Offer Submission Form constitutes only an offer to purchase and does not create a binding agreement between the buyer and seller. No contract for sale or purchase of the property shall exist unless and until a written Real Estate Purchase Contract has been executed by both parties.
  3. Offer Deadline and Format
    All offers must be received by the deadline stated on the property’s official webpage. Offers submitted after the deadline may not be considered. Each offer must clearly state the proposed purchase amount (“Offer Amount”) and indicate whether the buyer intends to purchase with cash or financing.
  4. Seller Review and Discretion
    All submitted offers will be presented to the seller after the submission deadline. The seller reserves the absolute right to accept, reject, or counter any offer, and to negotiate with one or more prospective buyers at their sole discretion. The highest offer is not necessarily the offer that will be accepted.
  5. Selection and Contract Execution
    The seller will have up to forty-eight (48) hours from the submission deadline to review and select an offer. Upon selection, the Real Estate Purchase Contract shall be executed directly following seller selection. The successful buyer shall then be required to provide the earnest money deposit within twenty-four (24) hours of ratification of the Purchase Contract. Failure to execute the contract or submit the required deposit within the stated timeframe may result in forfeiture of the opportunity to purchase, and the seller may proceed with another offer at their discretion.
  6. Contingencies
    I understand that my offer submission is not contingent upon further inspection, appraisal, or financing approval unless such contingencies are expressly included in and accepted as part of the fully executed Real Estate Purchase Contract.
  7. No Buyer’s Premium
    There is no Buyer’s Premium associated with this sale. The Offer Amount submitted represents the total purchase price to be paid for the property, subject only to standard closing costs as outlined in the Real Estate Purchase Contract.
  8. Agency Disclosure
    I understand that the seller’s broker and agents represent the seller in this transaction unless otherwise disclosed in writing. Any cooperating broker representing a buyer must be identified at the time of offer submission.

Auction Bidder Representation Form

I expressly acknowledge and agree to the following Terms and Conditions:

1. I have read, signed, and agree to be bound by, the Terms and Conditions of Participation for the Auction Sale of the above Property;

2. A commission of 10% of the 10% Buyer's Premium charged or 10% of any negotiated commission will be paid to any properly licensed real estate agent/broker whose Bidder is the successful purchaser for this property, and who actually closes and pays the total Contract Price and their Closing Costs for this property. It is understood and agreed that the real estate agent's commission structure will be based on the stated terms and conditions of sale;

3. Commission is contingent upon, and will ONLY be paid if Auction Bidder Representation Form is received by the auction company no later than 6 am Eastern on the day of the auction, no exceptions;

4. Real Estate Agent agrees that Real estate agent will not claim any exceptions to the foregoing procedures;

5. Broker agrees that if the commission is reduced due to negotiations, the commission to the broker shall be 10% of total commission earned;

6. Real estate agent agrees that real estate agent's commission will be due upon closing of the purchase by their Bidder with all consideration paid in full;

7. Registered real estate agent must attend all auction events with a live bidding component regardless if their bidder is bidding live on site or off site bidding on line and adhere to all terms. No oral registration qualifies for commission, and real estate agent must register client using this auction bidder representation form;

8. Real estate agent shall NOT be entitled to said commission on account of any sale to an entity of which (or any affiliate of which) the real estate agent is a principal, employee, or affiliate, or immediate family member;

9. A registered real estate agent can only represent one buyer at each auction event;

10. Real estate agent agrees that he/she shall hold harmless and indemnify Nicholls Auction Marketing Group, including its reasonable attorney’s fees, from any and all claims with regard to such commission.

  9. Can assemble, activate and coordinate event resources including staging, staff, equipment, record systems and accounting.
  10. Will candidly and professionally communicate today’s market realities and provide a full return on investment. 

Types of Auctions We Offer

Absolute Auctions

The word absolute is defined as being “free from restriction or limitation.” Absolute auction events are auctions when the product sells to the highest bidder regardless of price.  Since 1968, our firm has witnessed that absolute auctions increase your auction attendance and interest by at least 50% and increase your overall return by at least 25%.  We have personally sold several of our own family properties via this method.

Auctions with an Undisclosed Reserve Price

These are auction events in which the seller and auction firm mutually agree that the product will not sell unless and until an undisclosed reserve price is met or realized.  Quite simply, if the auction price does not meet or exceed the reserve price, the property does not sell.

Live Outcry Auctions

These are auction events that are held on site or at a neutral location, and are conducted by the auctioneer “calling the bid” in a traditional auction chant style.

Online Only Auctions

These are auctions that are totally conducted and transacted through 100% online bidding via the internet.  Typically, these are timed events where the buyer has a certain number of days or hours to competitively bid on property with a designated close time.

Live/Online Auctions

These are auctions where the seller and buyer can conceivably get the best of both worlds.  These auctions combine the “live outcry” method and the “online” auction method.  Buyers can choose either to show up at the auction and bid to the auctioneer “live on the lawn” or bid live real time online via the internet.  Our firm conducts these type of auctions at most of our events.

What situations warrant using the auction method of marketing?

When the clients objectives are to sell the property in the shortest possible time frame, truly see what the market will bear under terms and conditions favorable to the seller, and desire a marketing saturation of their property then auction is the way.
 

Is the auction method ever used as a first selling method? 

Yes, the auction method is not only the best but should be the first choice. An auction does not create the price ceiling that a conventional listing does. The seller can set the conditions for the sale and eliminate endless negotiations. . .
 

Are real estate auctions only for distressed properties?

No, most of our auctions do not result from repossessed properties, but rather are the result of the smart seller. A smart seller chooses the cost effective, accelerated method of selling property rather than listing the property for an undetermined length of time. Usually listings require long term marketing periods with multiple unscheduled, showings and creative, contingency offers. The auction method sets the date the property will sell and eliminates these hassles.
 

Can there be a reserve or a minimum bid on an item or piece of property?

Yes, the seller has the right to execute a reserve or minimum bid. This figure is discussed with the auction professional during early negotiations of the contract and is not disclosed to any potential buyer under any circumstances. The seller has the right to accept or decline the highest bid if it falls below the established reserve price.
 

If the high bid is less than my predetermined minimum value can I accept it?

Yes, the seller always has the right to sell the property at the highest bid price.
 

How long will the whole process take? 

Ideally, the contract must be signed at least 3-4 weeks prior to the auction day, the closing takes place approximately 30 days after the auction date.
 

Where will the auction take place?

On single properties the auction typically takes place on site, either in a tent, on the front porch, or in the living room. For multi-property or vacant land auctions a ballroom setting is typically more appropriate for the auction setting.
 

How long after the auction occurs will I get paid?

Approximately 30 days after the auction, a closing date will be set. At that time the property owner will be paid and turnover possession to the buyer. The closing will be insured by a professional title company.  If it is a personal property auction, you will get paid on auction day.
 

What factors determine the success at an auction?

Many factors contribute to a successful auction, the desirability of the property being sold i.e. location, condition and surrounding properties. Secondly, and most important, realistic expectations on the part of the seller. Every property has a value, when a property is properly advertised and promoted and two or more approved bidders are in attendance the high bid achieve is true market value. If the seller realizes this and is truly motivated to sell at the achieved price under stated terms and conditions a successful auction occurs.
 

What are the terms of an auction?

The terms and conditions are devised to protect the seller and the process of the auction method. Properties are sold “as is, where is” with all faults. The purchase agreement is produced with no contingencies, including those for inspections and financing.

 

What does auction day look like?

We suggest that you arrive 30-60 minutes prior to the start of the auction event.  Upon your arrival, you will have an opportunity to register & present your deposit check, meet our team, preview the property at your leisure and get all your questions addressed and answered.  The auction will start on time with the auctioneer highlighting terms and conditions, and then the bidding begins.  There will be bid assistants to help you during the actual bidding process and answer all your questions.  Your comfort and understanding during the bidding process is of paramount importance to us.  At the conclusion of the bidding (3-5 minutes), the new buyer will immediately sign the purchase documents and endorse their certified deposit check to our real estate escrow account.  The buyer will leave with paper copies of the purchase contract, and will also receive all documents in an electronic format.  Our closing coordinator will stay in contact with you and your title/closing company throughout the entirety of the closing period ensuring a smooth transaction.

Auction Terminology

AARE (Accredited Auctioneer, Real Estate)
The professional designation awarded by the National Auctioneers Association Education Institute to qualified real estate auctioneers who meet the educational and experiential requirements of the Institute and who adhere to a strict code of ethics and standards of practice.

Absentee Bid
A procedure which allows a bidder to participate in the bidding process without being physically present. A bidder submits an offer prior to the auction.

Absolute Auction
The property sells to the highest bidder regardless of price. This typically generates a much greater interest among potential buyers resulting in greater attendance at the auction , and a higher final sale price for the item in question.

Appraisal
The act or process of estimating value.

AS-IS
Selling the property without warranties as to the condition and/or the fitness of the property for a particular use. Buyers are solely responsible for examining and judging the property for their own protection. Otherwise known as "As Is, Where Is" and "In its Present Condition.

Auction
A method of selling an item in a public forum through open and competitive bidding.

Auctioneer
The person whom the seller engages to direct, conduct, or be responsible for a sale by auction.

Bank Letter of Credit/Guarantee
A letter from a bank certifying that a named person is worthy of a given level of credit.  Most often this is required when paying with none certified funds.

Bid
A prospective buyer’s indication or offer of a price he or she will pay to purchase an item at auction. Bids are usually in standardized increments established by the auctioneer.

Bid Assistant
A person who assists the bidder and the auctioneer. Calls out bidders’ bids, answers questions, and makes the bidder’s comfortable with the auction process

Bidder Number
Individually numbered card with your unique bidder number. This will identify you to the auctioneer as the successful bidder.

Bidder Registration
The process of registering your identity and ability to pay for successful bids. This is essential before bidding.

Bidder’s Choice
A method of sale whereby the successful high bidder wins the right to choose a property or properties from a grouping of similar or like-kind properties. After the high bidder’s selection, the property is deleted from the group, and the second round of bidding commences, with the high bidder in round two choosing a property, which is then deleted from the group and so on, until all properties are sold.

Broker Participation
An arrangement for third-party brokers to register potential bidders for properties being sold at auction for a commission paid by the owner of the property or the auction firm.

Buyer’s Premium
An amount (usually a percentage) that is added to the winning bid (hammer price) to determine the contract selling price which the buyer pays for the property being sold. The use of the buyer’s premium is so effective because it benefits both the buyers and the sellers.  Sellers benefit because it helps to defray many of the expenses associated with conducting an auction.  The buyer benefits because without the use of this tool, there may not have been an auction. The open and competitive bidding process might not exist if the buyer’s premium were not used to offset some of the auction related expenses.

CAI

These auction professionals have completed extensive and intensive auction leadership training at the Certified Auctioneers Institute (CAI) and have enhanced business and leadership skills. CAI auction professionals have completed three years of classroom, individual, and group work applied to their auction professional roles and business. Less than 850 professionals currently hold this designation.

Choice
When selling choice, the auctioneer is offering more than one item up for auction at a time. The winning bidder then has the choice to take one item or multiple items.  If the bidder wishes to take more than one item, the bid price will be multiplied by the amount of items the bidder chooses.

Clerk
The person employed by the principal auctioneer or auction firm to record what is sold and to whom and for what price.

Conditions of Sale
The legal terms that govern the conduct of an auction, including methods of payment, terms, buyers premiums, possession, reserves and any other announced by the auctioneer prior to the start of the auction.

Consignor
The person or authorized agent or entity that consigns goods to an auctioneer. The consignor is usually the seller.

Due Diligence
The process of gathering information about the condition and legal status of assets to be sold.

Hammer Price
The highest bid which is accepted by the auctioneer

Multiple Property Auction

Online Bidding
The procedure of submitting bids electronically by a mobile device or computer.

On-Site Auction
An auction conducted on the premises of the property or items being sold.

Personal Property
All goods and interests other than real property including chattels and commodities. Title for personal property sold at auction passes when the auctioneer accepts the final bid and announces the item sold (at the fall of the hammer).

Property Information Packet (PIP)

The package of information and instructions pertaining to the property to be sold at an auction event obtained by prospective bidders at an auction or from our website. Sometimes called a bidder packet or due diligence package.

Property Tour (Preview)
Specified date and time property is available for prospective buyer viewing and inspection. Also known as Open House or Inspection.

Real Property/Real Estate
Land and all interests therein, including all improvements to the land, such as buildings, fences, and fixtures. Title for real estate sold at auction passes at closing with delivery and acceptance of the deed.

Reserve Auction
The seller establishes a confidential reserve price and has the right to accept or decline the highest bid if it falls below the established reserve.  If the reserve auction method is chosen, it is imperative that the reserve price be realistic.

Sealed Bid Auctions
Each bidder submits a single, irrevocable bid without knowledge of the other bids. When the bidding period is closed, the bids are opened simultaneously, and the winner is the highest bidder.
